The Level of Constitutional Ignorance and Sheer Stupidity on the Left is just Staggering

During his lame-duck hanging on of office until the Trump inauguration, increasingly demented crime-family boss President JoBama O'Biden is pardoning lots of fellow office-holding felons and common criminals, saving himself for last, no doubt. And he is also

  • doing things to wreck the American economy and harm the hated bourgeois middle class of America, in deference to the "wisdom" of Karl Marx;
  • doing things to wreck the American national morality and set Americans against each other, in deference to his political sponsor George Soros;
  • doing things to weaken American national defense, in deference to his sugar-daddy, Xi Jinping. 

All of these things he is doing are intended, first and foremost, to hinder and perhaps stop if not reverse the incoming Trump Presidency plan from making America great again. To do that, O'Biden and his criminal Marxocrat Party have rushed all sorts of bills into existence for him to sign into laws, because it is deemed to be more difficult to repeal any law than it would be for any President to just undo any Presidential executive order, which he could undo with another executive order. 

To that end, they have a flurry of bills ready for Biden to sign and are rushing more into existence, and they have rushed to get funding past to implement the ones already signed into law, quick, before they could be defunded by the new Republicrat Congress. 

Among these are semiconductor subsidies, grants for climate change initiatives, and surging money and weaponry to Ukraine. And, there are the:

  • bipartisan infrastructure bill, adding 256 billion to the deficit;
  • inflation reduction act, which has nothing to do with inflation and everything to do with climate change and "green" politics, and is a lie on its face, and a lie in its very name. 

Among the new laws are one that outlaws gas powered home water heaters by the year 2029, and one that bans offshore drilling and one that bans oil and gas leases for 20 years, and more.

But here's the rub:  All of that is Unconstitutional!

Read Article One Section Eight of the US Constitution, which is the supreme law of the land. Every word of it is law. Every word of it is supposed to be under the protection of the President, the Congress and the Court, all of whom swore a solemn oath of office to protect it. It is the law of the land, the supreme law, binding on the federal government, state governments, local governments and the citizenry. 

Article 1 Section 8 of the US Constitution lays out the limited scope of federal government authority. If it's not in there, the federal government is forbidden, by constitutional law, to address it in any way. It lays out in specific detail the limited and enumerated areas the federal government is authorized to address in law, and if it's not in there, the federal government is commanded by the constitution to leave it alone. It is a matter for sovereign states, sovereign lower jurisdictions and the sovereign private sector to address or not address in lower laws, and lower rules, be they corporate, family, religious or personal. 

The federal government is not constitutionally free to issue one-size-fits-all laws affecting everyone in America in their choices of water heaters, what fuels they will use or not use, what cars they will drive or not drive, what minimum wage they will all be subjected to, what interest rate they will all be subjected to, what price controls they will all be subject to, what appliances they will all be able to use, what foods they will all be allowed to eat, what drugs they will all be allowed to use, what kind of housing they all may have, what health care and/or health care insurance they will all be forced to use, what children they all may be allowed to abort, what sexual perversions they all will be forced to celebrate, what kinds of people they all may be forced to hire, promote, rent or sell to, work with, work for, cater to, not shun, not keep apart from, etc., etc., etc., ad infinitum. 

To be Unconstitutional is to be Illegal

Nothing Obama is signing or ordering before he leaves office is legal. (Excuse me, I meant to say Biden.) You will not find any of it in Article 1 Section 8. Cars, appliances, fuels, energy, climate, environment, wages, etc., are not in there. So how do we explain all these laws and executive orders? The possibilities:

  1. They can't read.
  2. They can't properly comprehend what they read.
  3. They haven't even read the Constitution. 
  4. They have evil and subversive intentions.
  5. They are demented.
  6. They are stupid. 

These possibilities apply to both major and all existing political parties, which, by the way, are themselves unconstitutional governing entities in America. They have no constitutional business running either house of congress, or any other part of any government. Both major parties have been responsible for bringing into being all the unconstitutionally existing regulating agencies and bureaucracies, laws, executive orders, judicial precedents and regulations in existence today. 

The constitution is fixed, and unchanging short of ratified amendments.

But political parties never stop changing, and they ultimately wind up where ours are today, which is to vie for pure political power and drive to achieve one party rule, nothing more and nothing less. They certainly do not stand for the constitution; they all violate the constitution and they all seek pure raw political power for its own sake. 

They brought unconstitutional and illegal regulating monsters like the EPA into existence and nourished them. 

Both parties, indeed all parties, are guilty of it. 

But in this case, the Biden lame duck Presidency with Trump about to be inaugurated, they have handed Trump an Article 1 Section 8 huge political sword, with which he can simply lop off whole giant swaths of unconstitutional law and unconstitutional regulating government, if he will just pick it up and use it. 

As, constitutionally, the chief law enforcement officer of the nation who is sworn in his oath of office to defend the constitution against all enemies foreign and domestic, he has it in his constitutional power to declare anything that is unconstitutional to be unconstitutional, null, void, no law and/or no agency or bureaucracy, with all of their past regulations similarly nullified and voided. And he could, if he would, declare unconstitutional supreme court "precedents" to be unconstitutional, null and no precedent.

A few points on the President's constitutional power to do all that:

  1. 1803 Marbury v Madison established the constitutional principle of Judicial Review, by which the Court could strike down a law that was unconstitutional. This is the legal "precedent" that has been followed by all three branches of the federal government ever since the 1803 decision. And, the Court loves, stands on and protects legal precedent. 
  2. The very first and most important legal precedent established in American legal history was the ratification of the Constitution and the Bill of Rights. 
  3. The Constitution and Bill of Rights form one self-interpreting and easy to read legal document, written in English, that says very specific legal things. It was written as much for the American people as it was for the American government, which it governs. 
  4. The Constitution is the operator's manual for the three coequal branches of government to follow.
  5. The Bill of Rights is the American citizen's legal guarantee that their own constitutional government will not go tyrannical. 
  6. The constitution nowhere grants any special interpretive authority over itself to any one of the three coequal branches of federal government. 
  7. The legislative, executive and judicial branches must all equally know and obey the constitution in order to properly do their respective legislating, executing and adjudicating of federal law. 
  8. Any President, as the nations chief executer of federal law who is sworn to defend and uphold the constitution, is mandated by the constitution to declare unconstitutional, null and void such unconstitutionally established bogus "laws" and government entities as,
  • 1947 Everson v Board of Education
  • 1973 Roe v Wade and Doe v Bolton
  • 1979 Department of Education Organization Act
  • 2010 Patient Protection and Affordable Care Act
  • 2015 Obergefell v Hodges
  • EPA, HUD, CDC, ED, FDA, ATF, TSA, DHS, etc., etc., etc.

And everything else not found in article 1 section 8, or not a redundant copy of any other already existing government agency, such as Defense or Justice, established for national defense and public safety. 

President Trump can legally, legitimately and constitutionally strike them all down and take them out of existence if he choses to do so. 

The President would thereby establish a new constitutional principle of Presidential Review. 

All that being said, the future is not necessarily all bright and rosy for America; The parties are now so evil that I fully expect them to assassinate Trump, or try to, and to keep trying, over and over again. 

Your prayers for America must include prayers for Trump, because there is nobody out there like him who can pick up the sword of truth after him. 

As Yogi said, it ain't over till it's over.
