Today we see the anti Constituionalists gather for war against those who violate lesser laws. The Constitution itself may as well not even exist. But God help you if you violate any lesser law, most especially if it is an un-Constitutional law. And they'll really get after you if you dare to publicize the fact that they are all willingly, knowingly, voluntarily and purposely violating the Constitution.
Of course, what we're talking about here is the purely political use of the Patriot Act, the permanent recording of so-called "meta data" of every phone call ever made by any American citizen, and more. The permanence of this recording may be more dangerous to America than the actual recording. This presents a nearly irresistible tool of use in gaining political advantage, extortion, bribery and control of the citizenry. So, Rush is right; it all depends on who is doing it. However, there is another factor to consider:
It is wrong.
But then, before we even get time to digest the implications of the seemingly unlimited scope of how the Patriot Act is being used (or abused) we get the leaked story of the PRISM project run by the NSA, leaked by the now fired and despised fugitive Edward Snowden. Through which we are informed that NSA has been permanently recording full content of every email, chat, browse, search - you name it. Every key-stroke you make on your computer. Or any computer, or device of any kind, that accesses the internet in any way.
Every internet hub on earth is owned and operated by - guess who - the NSA. What we are hearing about in the current PRISM brouhaha is only involving NSA communications between NSA and the internet biggees, like Google, Facebook, Yahoo, Apple, etc.; what we don't know, and may never know, is what they filter and record that goes through all the internet hubs under NSA control. Which is all of them.
We're talking about a top secret political gold mine. And, we're talking about a very dangerous tool of control if it ever falls into in the hands of any would-be ruthless dictator. Which it has.
Nothing to see here, there is no problem with the Patriot Act or with Prism. We are assured from on high that all of this is for our own protection against terrorism, which, depending on what day it is, doesn't even exist, or is a problem again. Even john Bolton got in on the act. He said, essentially, two important things. That Edward Snowden committed a crime, and that the Patriot Act was perfectly legal, since it had the full knowledge, consent, approval and cooperation of both houses of Congress and the administration.
Is that what makes something legal?
Bolton's comments were a bit of a subterfuge since he was asked about unlegislated, top secret PRISM and offered a legal opinion about the properly legislated Patriot Act. John Boehner further revealed his own anti-Constitutionalism by calling snowden a traitor and defending PRISM as a necessary tool of defense against terrorism.
It is that attitude, held by men in power, that spells our national doom.
Is the Constitution a law, or not? That is what is at question here. If a law is on the books, and someone violates it, he commits a crime. If he willingly and knowingly commits a crime, he is a criminal. So it is of utmost importance to the American citizen to know whether or not the Constitution itself is law.
The Constitution says that it is law.
... This Constitution,
and the Laws of the United States which shall be made in Pursuance
thereof; and all Treaties made, or which shall be made, under the
Authority of the United States, shall be the supreme Law of the Land;
and the Judges in every State shall be bound thereby, any Thing in the
Constitution or Laws of any State to the Contrary notwithstanding. ...

The Constitution identifies itself as the supreme law of the land. But, John Bolton said that the Patriot Act was perfectly legal, because both houses of Congress and the white house were willingly cooperating in its execution. Directly interpreted, that would mean that we are no longer a nation of laws; we have become just another nation of men.
The
right of the people to be secure in their persons, houses, papers, and
effects, against unreasonable searches and seizures, shall not be
violated, and no Warrants shall issue, but upon probable cause,
supported by Oath or affirmation, and particularly describing the place
to be searched, and the persons or things to be seized.
-- Amendment IV, Constitution of the United States.
The fourth Amendment means that we the people have a legally established civil right to be secure in our persons, private property and communications. I submit that that legal civil right is violated by our government every single time any American citizen goes through any airport TSA screening authorized under the Patriot Act. Every such instance is a criminal act; a crime against the Constitution, and against the American citizen.
The Patriot Act was un-Constitutional as passed by both houses of Congress and as signed by President Bush. As a violation of the Constitution, its very purpose for being is to allow the government to commit anti-Constitutional crime. In my view, the legislators and executive who made it law committed a criminal act, and it was doubly criminal, because they all took an oath of office to protect and defend the Constitution. If it was done stupidly rather than with evil intent, then the stupidity certainly reached the level of complete incompetence in office. It was still a crime. If ignorance of the law is no excuse for us citizens, then what does ignorance of the law tell us about our current crop of highest office holders?
This is not the first time un-Constitutional law has been passed in America. Not by a long shot. I have railed against legislative, executive and judicial direct violations of the Constitution all over this site.
In my view, Edward Snowden behaved as he should have behaved in releasing this information. Any law or oath that he broke was an unlawful law or oath. Anyone who takes an oath to protect the Constitution is duty-bound and honor-bound to disobey any unlawful law or order, and anything that violates the Constitution is unlawful. The only question in my mind about Edward Snowden is if he has some undercover arrangement with Red China, since he took refuge in Hong Cong. We may not have the whole story, but I am glad we have this much of it.
Like all the other un-Constitutional laws we have spoken about herein, the Patriot Act awaits a President or a Congress with the balls to simply declare it to be un-Constitutional and therefore no law. All who have taken an oath to protect the Constitution are supposed to be prepared to do that.
Of course, that leaves out everyone today who is in high office.
